Terms
The agreement,in language you can read.
These are the terms on which castomFLOW is provided. They are written to be read rather than to be survived, and the section that matters most is the one about where responsibility sits for what a workflow does.
1. Who you are dealing with
Castomo prosta spółka akcyjna, ul. Powstańców Śląskich 5/212, 53-332 Wrocław, Poland. KRS 0001188843, registered by the Sąd Rejonowy dla Wrocławia-Fabrycznej we Wrocławiu, VI Wydział Gospodarczy. NIP 8993033031, REGON 542471636, kapitał akcyjny 100 000,00 zł. Contact: hello@castomo.com.
“We” and “us” mean that company. “You” means the person or organisation holding the account. Where the account belongs to a company, the person who opened it confirms they are entitled to bind it.
2. What you get
Access to castomFLOW at the plan you have chosen: the ability to build, simulate, publish, run and inspect workflows, with the step catalogue and allowances that plan includes. The plans and what is in them are on the pricing page, and that page forms part of these terms.
One castomo account covers every product in the family and one wallet pays for all of them. Using castomFLOW does not oblige you to use any of the others, and stopping one does not stop the rest.
We may improve, change and occasionally remove features. Where a change removes something you were relying on, you will be told in advance with enough notice to do something about it — and “in advance” means before it happens, not in a changelog afterwards.
3. What you may not do with it
Break the law with it. Send unsolicited bulk messages through it. Use it to harass, deceive or defraud. Attack, probe or overload it, or anybody else's systems through it. Resell access to the platform as if it were your own product — building workflows for clients is expressly fine, and is what the Team plan exists for; reselling the console as though you had written it is not.
Fair use applies to the things that are described as unlimited. Deterministic steps are unmetered because metering them would be silly, not because the capacity is infinite; if one workspace is consuming a share of a shared platform that affects everybody else, we will talk to you about it before we do anything, and doing anything means rate limiting rather than deletion.
4. Your data is yours
The workflows you build, the configuration you write and the data that passes through them remain yours. We claim no ownership of any of it and no licence to it beyond what is needed to run the service you asked for: storing it, processing it as your workflow instructs, and showing it back to you.
We do not train models on your workflow data. We do not sell it, and we do not mine it to build a product. The privacy page sets out exactly what is held, for how long, and what an AI step sends where.
You can export your workflows and your run history at any time, and deleting your account deletes them. What survives is what the law requires us to keep, principally invoices.
5. Billing
Plans are billed monthly in advance. Prices are quoted excluding VAT, which is added at the applicable rate. There is no minimum term and no notice period: change plan or stop, and the change takes effect from the next billing period.
Stopping does not delete anything by itself. Your account continues on the Free plan, with the limits of the Free plan, until you delete it. A workflow that exceeds those limits is switched off rather than run and billed.
If a payment fails we will tell you and try again before anything is suspended. If a plan's price changes you will be told at least thirty days beforehand, and you may leave rather than accept it.
6. Where responsibility sits
This is the important section, so it is written plainly.
We are responsible for the platform: that a published workflow runs the version it was published on, that a step executes as documented, that a retry does not send the same message twice, that your credentials are stored encrypted and not disclosed, and that a run is logged so you can see what happened.
You are responsible for the workflow: what it does, who it messages, what it writes to which system, what it deletes, what it charges, and whether any of that is lawful and sensible in your jurisdiction and your industry. A workflow that e-mails ten thousand people who did not ask to hear from you is a workflow you built. The platform sent it because you told it to.
That line applies equally to AI steps. A model's output is a step's output, and a workflow that acts on it without a check where a check was warranted is a design decision you made — which is why simulation exists, why approval steps exist, and why an AI step's output is validated against a shape you defined rather than passed on blindly.
7. Liability
We provide the service with reasonable skill and care. We do not warrant that it will be uninterrupted or error-free, and we are not liable for failures in systems that are not ours — a provider whose API is down, a carrier who loses a parcel, a model provider having a bad afternoon. Where that happens a workflow retries, and then stops visibly with a reason, which is the most any honest system can offer.
Our liability to you in any twelve-month period is limited to what you paid us in that period. We do not exclude liability for anything the law does not permit us to exclude — death or personal injury caused by negligence, fraud, and rights that a consumer has by statute.
Neither of us is liable for indirect or consequential loss. If your business depends on a workflow completing at four in the morning, build it so that a failure is visible and recoverable, and test that with a simulation — the tools for that are all in the product and this clause is the reason they are.
8. Suspension and ending it
You may stop at any time, from the console. We may suspend an account that is breaking section 3, that has an unpaid invoice after we have told you about it, or that is being used in a way that endangers the platform or other customers. Except where the law or an immediate risk requires otherwise, you get notice and a chance to fix it first.
After termination your data remains available for a reasonable window so that you can export it, and is then deleted.
9. Changes to these terms
Material changes are announced to account holders at least thirty days before they take effect, and continuing to use the service after that date is acceptance. If you do not accept a change, stop before it takes effect and nothing further is owed.
10. Law, and where a dispute goes
Polish law applies. If we cannot resolve something between us, the courts having jurisdiction over our registered seat in Wrocław will decide it. Nothing here removes a consumer's right to bring proceedings where the law says they may.
If any of this is unclear, write to hello@castomo.com and ask. A term you had to guess at is a term that will cause an argument later, and we would rather have the conversation now.
